Processing of personal data

Personal or institutional data provided through this website will be included in a file owned by the MCNG. Contact details will only be used to a) keep you informed through the project’s e-newsletter, b) contact you regarding one of your observations, or c) send you third-party requests to use your data.

Personal data will not be transferred to third parties without previous consent except when the current legislation allows it. Access, rectification, suppression, opposition and limitation rights can be exercised in accordance with the provisions of Regulation (EU) 2016/679.


Processing of your data and observations

The monitoring program www.batmonitoring.org is designed to obtain solid and impartial environmental data that contributes to biodiversity conservation policies and a better knowledge of bats. Therefore, all entered observations are integrated into the database associated with the portal and managed by the MCNG, where they are stored, processed and analysed according to the permissions ascribed by the users (owners from now on).

When entering any data, users/owners will have to assign a level of privacy, which can only be modified by the owner or the database manager with the owner’s express consent. In this regard, two types of data are established, public and private, managed according to the following guidelines:

2.1    Public data, which is regulated by the following administration, visualisation, and sharing guidelines:

§  2.1.1. Sharing with Catalan autonomous and local administrations:

Public data collected in the Catalan range will be shared with the Catalan public administration without the owner’s express authorisation as long as it is solely used for management and conservation. Any other use of the data related to publication or scientific or academic exploitation will require the owner’s explicit approval. 

§  2.1.2.  Sharing data collected in Catalonia with other physical or juridical individuals:

Public data collected in the Catalan range will be shared with public or private entities not included in section 2.1.1. when its use is strictly linked to environmental management, upon request with revocation right by the owner. Two weeks after the request, the data for which there is no express refusal of permission to use by the owner will be shared. This process also includes any other purpose related to the publication or scientific or academic exploitation of the data.

§  2.1.3.  Sharing of data from other geographical areas with Institutions or private entities:

Public data collected outside the Catalan range or requested by individuals or entities not established in Catalonia will only be shared after the owner’s express approval, who will be duly informed about the requesting entity and the intended use of the data. The owner’s silence in any petition will be taken as a refusal of the requested use.

§  2.1.3. Data summary display (maps, graphs and tables) of the portal:

Public data will be displayed in several cartographic, graphic and numeric displays available on the portal. The displayed resolution of the data will be conditioned by the species’ sensitivity and the nature or origin of said data. Species included in threatened species catalogues will be displayed in a lower resolution to avoid showing their exact location. Roost data (either caves, bat boxes or others) will always be shown in low resolution, making it impossible to extract the exact locations.

 

2.2    Private datawhich is regulated by the following administration, visualisation, and sharing guidelines:

§  2.2.1. Sharing with any public or private entity or individuals, regardless of their geographical and competence scope:

Private data will only be shared if there is express approval from its owner. The portal solely acts as a mediator between the requester and the data owner.

§  2.2.2 Data summary display (maps, graphs and tables) of the portal:

Private data will not be publicly displayed on the portal. Only the owner can view them by accessing the portal using their registered user.

 

By participating in this project, you allow us to store and manage your observations in accordance with the provisions of points 2.1 and 2.2 of this regulation.

Authorship is an intrinsic part of every observation, and consequently, both on www.batmonitoring.org and on other viewers and information channels linked to this project, the owner’s name may be associated with their observations and, therefore, be visible to the general public when the data is public. On the other hand, the owner’s name may appear in sections, statistical rankings, or different types of queries/visualisations.

Observations concerning species included in national or regional threatened fauna catalogues, even when explicitly stated as “public”, will not be visible to other website users. The rest of the public data, as well as the coordinates of the locations where the observations were made, may be consulted by other website users.

The data and observations provided by the owners/users are of a scientific nature, so any data sent to www.batmonitoring.org will be integrated into the database that the MCNG undertakes to keep accessible and functional for an indefinite period of time


Policy for the Safety & Protection of Minors

To register on www.batmonitoring.org it is essential to be over 18 years of age or, failing that, to have the authorisation of the parent or legal guardian of the minor

Changes to our Privacy Policy

The MCNG reserves the right to modify or adapt this Privacy Policy to future requirements or needs that may arise, being obliged to communicate it to all users/owners and without the changes resulting in a temporary loss of data privacy in accordance with the policy at the time they were introduced on the portal. If you do not agree with any of the changes made to our Privacy Policy, you can unsubscribe by contacting us at the address indicated above.

The www.batmonitoring.org website, as well as the rest of the viewers and other information channels linked to this project, are the property of the MCNG. All rights to its content (except for user-contributed data), images, texts, and design are owned by the MCNG or, in the case of some photographs, by the authors who created them. All elements of this page, including but not limited to its design and content, are protected by Intellectual Property laws, industrial property, and international treaties related to Authors’ rights

Use of its Content

Unless explicitly authorised by the MCNG, the content of this website cannot be reproduced, transmitted, or exploited in any way except for educational or strictly personal use and under no circumstances for commercial purposes. The content must always maintain the authors’ rights and other ownership notices unchanged. 

Responsibilities

3.1. Although the MCNG puts its maximum effort into ensuring the precision and accuracy of the content of this website, it might contain errors or inaccuracies. Consequently, we do not guarantee its content’s truthfulness, reliability, or accuracy.

3.2. The MCNG is not responsible for information on third-party websites connected by links to www.batmonitoring.org. 

3.3. Under any circumstances, the MCNG will be held responsible for any damages or losses of any type from or related to the use of this webpage.

Divisibility 

If any provision of these conditions is or becomes invalid or unenforceable under applicable law, it would only be invalid in this matter, and such provision shall not affect the validity of the remaining provisions of these conditions.  

Legislation and applicable jurisdiction

These terms of use shall be interpreted and governed by the current legislation. Any dispute arising from these conditions shall be settled before the courts of Granollers, Catalonia. However, this shall not prevent the MCNG from exercising the right to settle any dispute in another competent jurisdiction.

MCNG reserves the right to change the content of this website at any time and without prior notice.
